It is decided on the final standings, not on a rating you hit once. The title is awarded when the season ends to whoever sits in the top 0.1% or top 8, whichever is higher. That is why this is a season-long hold rather than a single push, and support will explain exactly how the bracket is maintained through to the close.

No, and the difference matters. Regular Legend is a rating you earn in the Shuffle bracket and it awards a pennant and a temporary title. Venomous Legend is the top 0.1% end-of-season placement, which is permanent and held by only a few players per region.
