Notice and Takedown Policy

October 29, 2026

Kingboost (hereinafter referred to as the “Company,” “we,” “us,” or “our”) operates an online platform (the “Platform”) and may qualify as a “service provider” under Section 512(k)(1) of the United States Digital Millennium Copyright Act (“DMCA”). The Company is committed to complying with applicable DMCA requirements, including the safe harbor and liability limitation provisions set forth in Section 512.

We respect the intellectual property rights of others and expect all users of the Platform to do the same. This Notice and Takedown Policy establishes the procedures for submitting, reviewing, and responding to claims of alleged copyright infringement involving materials made available through the Platform.

The Company does not adjudicate disputes regarding the ownership, validity, or infringement of intellectual property rights. In accordance with the DMCA, our role is limited to receiving and processing copyright infringement notices and counter-notifications. We do not independently determine the merits of the allegations or counterclaims submitted to us.

Any removal of content, restriction of access, restoration of material, or other action concerning allegedly infringing content will be carried out in accordance with the procedures outlined in this Policy, applicable law, or a valid court order.

This Policy applies exclusively to claims of alleged copyright infringement. It does not govern trademark disputes, defamation allegations, privacy complaints, contractual disagreements, or other types of legal claims.

1. DMCA Notice

If you believe that material available through the Platform infringes your copyright, you may submit a written copyright infringement notification (a “DMCA Notice”) containing the information required by 17 U.S.C. § 512(c)(3), including the following:

(a) An electronic or physical signature of the person authorized to act on behalf of the owner of the exclusive right allegedly infringed.

(b) Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notice, a representative list of those works may be provided.

(c) Identification of the material alleged to be infringing, or involved in infringing activity, that should be removed or made inaccessible. The notice must provide sufficient information to enable the Company to locate the material, including the relevant URL or other identifying details.

(d) Sufficient contact information to allow the Company to reach the complaining party, including their full name, mailing address, telephone number, and email address.

(e) A statement confirming that the complaining party has a good-faith belief that the disputed use of the material is not authorized by the copyright owner, the owner's representative, or applicable law.

(f) A statement confirming that the information provided in the notice is accurate and, under penalty of perjury, that the complaining party is the owner of the exclusive right allegedly infringed or is authorized to act on behalf of that owner.

2. Submission of DMCA Notices

DMCA Notices must be submitted through one of the designated reporting methods available on the Platform:

  • By completing and submitting the form accessible through the “Report Offer” button on the page displaying the allegedly infringing content. This reporting option may not be available for every offer.
  • By completing and submitting the DMCA reporting form accessible through the “Report DMCA” button in the Platform's footer.

Copyright infringement notices must be submitted through one of the designated reporting channels described above. Notices, takedown requests, correspondence, or other communications concerning alleged copyright infringement sent through alternative channels, including customer support, social media, or general contact forms, may not be accepted or reviewed.

The Company reserves the right to request additional information or supporting documentation to verify the identity, authority, or ownership rights of the person submitting a DMCA Notice before taking action.

Notices that are incomplete, inaccurate, or otherwise fail to satisfy the applicable legal requirements may not be processed. In accordance with 17 U.S.C. § 512(c)(3)(B), a notification that does not substantially comply with the requirements of Section 512(c)(3)(A) will not be considered when determining whether a service provider has actual knowledge of infringing activity or awareness of facts or circumstances indicating such activity.

3. Action Upon Receipt of a DMCA Notice

Upon receiving a DMCA Notice that substantially complies with the applicable legal requirements, the Company may take one or more of the following actions:

(a) Remove the allegedly infringing material or disable access to it.

(b) Notify the user who posted, uploaded, or otherwise made the material available through the Platform (the “Recipient”) that a DMCA Notice has been received and that action may be taken concerning the material.

The Company may take any additional steps reasonably necessary to process the notice in accordance with applicable law and this Policy.

4. Counter-Notification

If you are a Recipient whose material has been removed or whose access to material has been disabled following a DMCA Notice, and you believe that the action resulted from a mistake or misidentification, you may submit a written counter-notification pursuant to 17 U.S.C. § 512(g)(3).

Your counter-notification must include substantially the following information:

(a) Your physical or electronic signature.

(b) Identification of the material that was removed or made inaccessible, together with information identifying where the material appeared before its removal or restriction.

(c) A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification.

(d) Your full name, mailing address, telephone number, and email address.

(e) A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if you reside outside the United States, any judicial district in which Deval Ltd may be found. You must also agree to accept service of process from the person who submitted the original DMCA Notice or that person's authorized representative.

5. Action Upon Receipt of a Counter-Notification

Upon receiving a counter-notification that substantially complies with the requirements of the DMCA, the Company may take the following steps:

(a) Take reasonable measures to promptly notify the party who submitted the original complaint that the material has been removed or access to it has been disabled.

(b) Provide the complaining party with a copy of the counter-notification and inform them that the Company intends to restore the material or cease restricting access to it within 10 business days.

(c) Restore the removed material or cease disabling access to it within 10 to 14 business days after receiving the counter-notification, unless the Company receives notice from the original complaining party that they have filed a court action seeking an order to restrain the Recipient from engaging in allegedly infringing activity involving the material on the Platform, as provided under the applicable provisions of the DMCA.

All actions under this section will be carried out in accordance with applicable statutory requirements.

6. Misrepresentations

Any person who knowingly submits a DMCA Notice or counter-notification containing materially false statements, misrepresents relevant facts, or abuses the procedures established by this Policy may be subject to liability under applicable law.

Such liability may include damages, costs, and reasonable attorneys' fees pursuant to 17 U.S.C. § 512(f), where applicable.

By submitting a DMCA Notice or counter-notification, the submitting party acknowledges that the information provided must be truthful, accurate, and submitted in good faith.
